Navigating OBBBA: Why a Strong GP Team is Essential for Pharma Compliance

On July 4, 2025, the One Big Beautiful Bill Act (OBBBA) was signed into law, marking a significant shift in Medicaid, Medicare, and federal drug pricing policy. While broad in scope, its provisions have direct consequences for pharmaceutical manufacturers—especially those participating in government programs. Looking at only a few of these new regulation shifts, it becomes clear that a strong and experienced Government Pricing (GP) team is now more critical than ever for ensuring compliance and protecting revenue. 

OBBBA Implications for Manufacturers 

  • Enrollment Verification: States must routinely cross-check beneficiary data across federal and state systems. This will reduce ineligible or duplicate enrollees and may shrink covered populations, resulting in fewer Medicaid prescriptions. 
  • Eligibility Redeterminations: Beginning in 2027, many Medicaid recipients will face automated eligibility checks every six months. This could lead to increased volatility in program participation which will make utilization forecasts and financial planning more difficult. 
  • Non-Citizen Restrictions: As of late 2026, Medicaid coverage will narrow for certain non-citizen groups, further reducing the covered population. 
  • Overpayment Accountability: Starting in 2030, states will face penalties for not resolving identified overpayments. This is likely to push stricter rebate enforcement downstream to manufacturers. 
  • Orphan Drug Carveout: OBBBA reaffirms that orphan drugs are excluded from Medicare’s Drug Price Negotiation Program. This preserves vital incentives for rare disease innovation, helping manufacturers continue investment in R&D while protecting patient access.

Why a Strong GP Team is Critical 

A strong Government Pricing (GP) team is no longer optional—it is the backbone of compliance under OBBBA.

Beyond number-crunching, GP teams must: 

  • Interpret Regulatory Shifts: Understand and translate OBBBA requirements into actionable compliance strategies
  • Validate and Audit Data: Ensure that every calculation and submission is accurate and defensible to avoid potential penalties and lost revenue
  • Manage Risk Proactively: Anticipate audits, enforce data integrity, and identify compliance gaps before regulators do

Manufacturers with well-resourced, empowered GP teams will be best positioned to manage rebate obligations, protect revenue, and maintain credibility with regulators.
